NEW YORK - New York State has signed a law banning novelty items powered by mercury batteries, such as a Spiderman 2 toy found in cereal boxes.
The state imposed the ban on novelty products containing mercury, saying the element is a toxic pollutant.
Mercury accumulates in fish, causing neurological damage in humans. Health Canada guidelines say pregnant women and young children should not eat predatory fish such as shark, swordfish, and fresh and frozen tuna more than once per month.
New York's law, which goes into effect in January, also requires products containing mercury to be labelled and disposed of properly.
The "Spidey-Signal" toy uses a mercury-powered battery to project a web-shaped light. The toy has also been recalled in Connecticut and New Hampshire, which require a warning about disposing the batteries.
A Kellogg's official in the U.S. said the toys don't compromise the safety or quality of the food.
More than one million of the toys have been distributed as part of the Canadian promotion, which began last month.
Kellogg's said the toys don't violate any Canadian regulations.
